Narrator: Daily each person gets different types of experiences. Whether all the experiences are making you happy?? The answer for this will be NO. But do you know that whatever experience you get, you can make into a happy experience? A small story on this. A boy had an inferiority complex of being very lean. So he never used to mingle with anyone and he always used to be alone. He had no control over his life and he finished his schooling and joined the college for his higher studies. While he was plying alone, because of some things he did, many people started appreciating him and he started feeling happy and energetic. He started feeling and enjoying within himself the appreciation he got by others. After that happy things started happening around him. He was exhilarated and felt like he is flying. He was surprised to see the changes happened within himself and he started thinking about it. When he joined neuroscience for his higher studies, he got the answers for this. Yes dear friends, whatever type of feeling we are in, the same type of things happens around us. That is, if we think positive, positive things happen around us, in the same way, if we think negative, negative things happen around us. That young boy understood this. All are thinking that everyone should like us, notice us and everyone should appreciate us. But in this busy world, we all are running behind something and we don't have time to appreciate anyone or love anyone. NeuroPsychology says that, you just have to try a little to change things happening around you in the way you want it. Your thoughts will become reality. If any happy incident has happened in your life, think about it again and again. And register it in your mind. Relations you like, friends, your higher authority and the experience of others appreciating you, things done by others out of love, think all these and make it alive again. Things which are getting registering in your mind will change into feeling, and when that feeling changes into an experience it always gives you excitement. And you can feel it. Emerge yourself in that feeling for 20 minutes. Continue doing this for some time. After a few days, with the changes around you, you can get permanent happiness.

Narrator: This incident happened during 1880s, in Italy's Bologna city. A boy named Guglielmo. His father Giuseppe was a religious person. To give the best education for his son, he asked teachers to come to his house to teach him. He made his son study by building a library inside his house and by bought many kinds of knowledge related books. Son Guglielmo grew up as a person with good knowledge and intelligence. One day during the evening hours, his father Giuseppe was praying. His lips were moving with Lord's prayer "Our gracious heavenly father". A growing up boy with knowledge started laughing by seeing this. Then the father asked, " Why are you laughing?" For that young Guglielmo answered, dad you are praying by saying, Our gracious heavenly father, where is that heaven? For that his father closed his eyes and looked unto sky and stretched his arms and said, above this sky, my son. For that the intelligent son asked, Dad how can the Lord hear your prayers who is far away from here. I am standing next to you but i am unable to hear it. He said this and giggled again. The father didnt get angry by seeing his son giggling at him for his prayers. He appreciated him and said, you are really intelligent. God has made you to think and ask this question. The same God will make you understand one day. He said this and continued his prayers with a smile. Days passed. Guglielmo grew up with the question, how the Lord in heaven will hear your prayers from here? Then he did some reviews and research. He proved that voice rays pass from many thick and thin things. He invented Wireless telegraphy. He made ways for boats and ships to send messages to seashores. He helped many in saving their life from tragedy. On 1901 December 12th, he fixed kite-supported antenna to receive signals and the distance between the two points was about 2,200 miles. He continued his research and found that we can send messages for thousands of miles. After so many researches, an Appreciation Ceremony was organized in his home town Bologna city. At the end of the ceremony, that young boy shared in his speech that, when i was a kid, i giggled and asked my dad, how can Lord hear your prayers who is far away from here. Even i am standing next to you but i am unable to hear. Now i can understand that, when people can hear messages from thousands of miles through the instrument which is invented by me, then the Lord will also can hear my dad's prayers. He finished his speech. Yes, do you know the name of that young Guglielmo's full name, who asked question? He is none other than Guglielmo Marconi, who is known as Marconi. As a result of continued research on how can the Lord who is far away from here, will hear your prayers, he invented radio. This radio is helping millions of people across the globe. Narrator: Hello friends. Can we hear more about history of law related to payment of wages. James: Under 1936Act's protocol the payment of wage is mentioned. Before 1936, there was a nonsystematic practice among the workers. Weekly wages, daily wages, wages given once in 6months, wages given once in a year, many such practices were practiced by companies and owners. By understanding this and based on a complaint given by individuals, few verdicts were given. Among those verdicts, main one was, weekly wage system. They have passed a bill call, weekly payment bill. It came to existence in the year 1925. Under this Act, the payment should be given to the workers at the end of 6th working day. i.e if a worker is working from Monday to Saturday, he should be given the payment on Saturday evening. The GO was passed. After that many protests were conducted in different places. As a result of a continued protest by workers, a team was formed in the name of royal commission on labour. This team proposed some points to central Govt. Based on those suggestions, Payment of Wages Act was introduced in the year 1936. This Act explains about how wages can be calculated. Based on the work culture, man power of the worker involved for the work, how many calories a worker is burning to the work, will be calculated and based on that wages will be calculated. Though this was not accurate, but it was given on an approximate rate. Earlier it was even applied to Railways dept. As per the Act, If the work is given to a contractor, even the contractor should pay the wages to their workers accordingly. If the contractor has appointed 2 more contractors under him, even for them this law is applicable.

Narrator: Hello friends. We have TTCU's state consultant James Victor to talk about Over Time. James: As per law 8 hours of work is designed for any worker. Can a worker work more than 8 hours which is prescribed by law? Yes he can. How? Firstly, he should be willing to do it.Then can he work one more shift after his shift? No? Then how to do it? They need at least one hour of rest after their shift. After one hour of rest can they work another 8 hour or another shift? No. Then he can work for another 4 hours after taking 1 hour of rest. Can he work daily for extra 4 hours? No even for this law has not given permission. Maximum of 3 OTs can be done by a worker. That is, he can work for extra 12 hours per week. Monthly, a worker cannot work for more than extra 48 hours. How the wages should be given to that worker? If a worker is working after his shift and taking one or half an hour of rest, if he is working for extra 4 hours he should be paid for 8 hours. This is called as double wages. If he is working for 1 hour, he should be given the salary of 2 hours. So if a worker has worked for 48 hours he should be paid for the 96hours wage. This is mentioned in Law. But practically it is not possible. In many companies, they are giving single wages. Iff they are working for 1 hour, they will be paid for 1 hour only. I believe that it out of law. Many unions and workers are not taking it to court because of the fear of losing the job, or the fear of facing other problems in the company. For these reasons, unions and workers are not making it an issue. But worker should understand that law doesn't say so.

Narrator: Once a teacher asked his students, is there anything which God cannot do? all students felt laughing when they heard this. They laughed saying, is there anything which God cannot do??!! Only one boy stud up and said yes! The teacher was surprised. The teacher asked with surprise, is there anything which God cannot do?? He asked, what is that thing which God cannot do? The boy replied immediately, not all can be satisfied. Yes my dear friends, we create money and people started looting the money of workers. Now we have laws for all these. At least not a correct wage but minimum wage can be given. Yes, now can we listen to Minimum wage act??!! Minimum wage act was created in 1947. When we hear minimum wage, we get a question about what is correct or fair wage? Minimum wage or fair wage, let us see ho is it calculated. Law considers the family as it consists on Husband, wife and 2 kids. For the daily living of these 4 people i.e health, value, facilities, education etc will be received without any problem. This is called as fair wage as per law. If the wife or anybody else is earning in the family, it will not be considered. Now let us see the calculation minimum wage. For the family of 4, basic facilities like, food, clothing, medicine, education, should be received without any hindrance. To receive all these in basic way is minimum wage. It is really sad that in many companies getting minimum wage has also become the main challenge. Even this minimum wage differs from districts, cost of living in that area, type of work, skill of the worker, the capacity of the company to pay salary. There is a situation where the minimum wage cannot be equal in all areas. State Govt discusses with central govt once in every 5 years and it increases or changes the minimum wage. Petrol, Gold, and eatables are changing their prices daily but workers minimum wage stays the same for 5 years. All types of workers are expecting that this should change. In the same way workers are expecting that at least the minimum wage should be given to all workers.

Narrator: From past 3 weeks, we heard many things about ESI. Now we can hear the answers for the questions asked by our audience. 1) Law says that all the workers of the company should be made the arrangement of ESI. If the organisation is denying to give the facility, where can we give a complaint and get the ESI facility? Ans: ESI coverage should be given to the worker from the time he joins. If a company is not giving, there is an exclusive office for ESI, and there is an officer for that. You can give a complaint to him. Maybe sometimes, ESI coverage may not be applicable to that area. If there is an ESI hospital the 10 km surrounding areas companies will be covered. If there is no ESI hospital nearby, your company should have joined you with any insurance company. So its not just ESI it can be any other insurance coverage. So there are 2 types in it. You can make use of it. 2) Many of the workers complain that, every month they have been deducted a particular amount for ESI but we have not been given ESI card. So what a worker should do to get this ESI card? Ans: ESI card is a family card which looks almost like ration card. AT the backside of the card, the photos and the details of the family members will be given. Once the member is registered by your company, the ESI will give you the card. In many companies they are keeping the ESI card with them, because they think that the worker may loose the card. This is wrong. There is a lot of difficulty in getting this card. so they are doing this. But this is not necessary. If a worker is loosing a card, they can get it by filling an application form. So for sure the worker should be given the ESI card. If they are not giving, you can complain to ESI office. 3) If a worker who has ESI card is getting heart attack while going or coming from the company. And someone is calling 108 and they are taken to nearby hospital. During such time, that medical expenses will it be covered in ESI? Ans: In many places, ESI facility is not only available in ESI hospital but also available in emergency and specialty hospitals. If a worker is sick he will be admitted in some hospital. If you see, in many hospitals, it will be written that ESI coverage is available. So in all cities, there will be few hospitals like that. In such hospitals, ESI coverage is applicable. They can write to ESI office and get the money. 4) Is this ESI facility available for all the Govt and Private hospitals? Ans: For Govt hospitals, ESI facility is available. And as far as private hospitals are concerned, When a mill worker is admitted into a hospital, you can tell them openly that he is a worker and he has ESI coverage. The hospitals will guide you whether it is applicable in their hospital or not. If not they will guide you to the hospital which covers ESI. In such incidents you have to ask and get the information.

Narrator: A person's life is based on where he lives, life, community, death, culture, civilization, politics. But experience is something we get from others. But education is something a person gets from skills and based on his knowledge. We have James Victor State consultant of TTCU with us to share more on ESI. James: ESI act 1948, we are going to see more about this law. Many will a question that what is the age limit to get insurance. A person who works in mill, and getting salary less than Rs.15000 are eligible and comes under this scheme. Physically challenged people who are getting salary up to 25000 are also eligible for this scheme without any age restriction. Next is who all will get extra benefits. It is divided into 3 parts. Under section 2,6 a widow of a worker, next is son who is under 25 years or adopted son. They will come under these criteria. Unmarried daughter and adopted daughter also come under this scheme. If they have a widow mother, even she is also covered under this scheme. So they all will get the benefits. So the ESI act covers the entire family. ESI has many insurance and medical benefits, so it is always good and adviced to get ESI benefit.

Its our confident which believes that what we got is better than what we have lost. As per Emerson's words, to help ourselves, ESI is going to help us. This New year January we have Mr. James Victor TTCU state consultant to share more on ESI. James: ESI hospitals are available in all cities. Especially in the areas where number of mills are more. These hospitals will be commenced on the basis of the number of workers in the mill. This is not only for the workers but also for their family members. To get the facility what you have to do is, take a group photo along with husband, wife, kids and if you have old aged parents. Submit it to ESI hospital and get the approval from ESI hospital too. When they go to ESI hospital they will get a ESI number and card. When they go like this they will get free health treatment. ESI has all the facility of operation, taking treatment by staying in the hospital and you can go and come bakc daily for the treatment. ESI has all the facilities. So ESI is really important Act. No worker should never say No for this facility. There is a situation where sometimes it may and may not apply to some mills. For eg. This is applicable only for those mill workers whose mill in near 10 km surroundings. If there is no ESI hospitals within 10 kms, the company has to take special insurance and all the workers should be part of it. In coming episodes we can see what all treatment can be taken, for whom is it applicable etc.

Narrator: Know more about ESI in Urimai kural this month. We have TTCU state consultant Mr. James Victor sir to share more about ESI. James: ESI act 1948 came to existence in 1948. This was introduced for the Socioeconomic justice of the worker. In 1955 because of the effort of the workers of Coimbattur, this has come up with the improved version. In 1948 when it was introduced PF was used when a worker dies or he meets with any accident or when a women worker undergoes any major surgery. As per this act, if the number of workers in any company is 10 -12 this act applies to them. Almost for all the companies or mills, this act applies. From day 1 of the worker, this act will be applied. The necessary documents should be prepared and submitted by the company to ESI office. Normally 4.5% will be contributed from the employer and 1.7% from employee should be paid in ESI office.
